I’m going to talk to you today a little bit about criminal law, specifically what to do if you feel like you are being investigated or are suspected of committing a crime. I know that it can be a little bit overwhelming if police are in your home or if you’ve been pulled over or if you encounter them on the street and they start asking you questions.
One thing you need to ask law enforcement is are you being detained. If you are not being detained, you are free to go and you do not have to answer any more of their questions. One thing that you should probably keep in mind is law enforcement isn’t there because they are your friend. They may be polite to you they may be friendly with you, but they are collecting evidence or gathering data potentially to find probable cause to place you under arrest.
So, the next thing that comes is if you are being detained or if you are being placed under arrest. They want to continue asking you questions, you do not say anything. The only thing that should come out of your mouth is that you would like an attorney.
